These Terms and Conditions (“Terms”) govern your access to and use of lifestylepoolandspa.com (the “Site”), which is owned and operated by Lifestyle Pool and Spa, LLC (“Lifestyle Pool and Spa,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

About Us

Lifestyle Pool and Spa is a family-led, Florida-Certified Pool & Spa Contractor (License #CPC1460980) with over 30 years of pool-building experience serving Hernando, Hillsborough, Pasco, Polk, Lake, Sumter, Pinellas and Manatee counties. We design, build, remodel, and service inground pools, spas, decks, and outdoor-living spaces.

Use of the Site

You may use the Site to learn about our services, view our project gallery, request consultations, submit warranty requests, and contact us. You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to any portion of the Site, our servers, or third-party services we use.
• Interfere with or disrupt the Site, including by introducing viruses, scraping at scale, or running automated requests that degrade service.
• Impersonate any person or misrepresent your affiliation with any person or entity when submitting forms.
• Use the Site’s content for commercial purposes without our written permission.

Consultation Requests Are Not Binding Contracts

Submitting a consultation form, sending a message, or speaking with us by phone does not create a binding construction contract. Pool design, construction, remodeling, decking, and outdoor-living work is performed only under a separate written contract that is signed by both you and Lifestyle Pool and Spa. That contract — not the Site — defines the scope of work, schedule, pricing, payment terms, warranties, and dispute-resolution process.

Pricing and Estimates

Any pricing, timelines, or build references published on the Site (including the “Custom Pools Built in 75 Days” messaging) are illustrative averages based on typical projects and do not constitute a binding estimate. Actual pricing and build schedules vary based on site conditions, design scope, soil and structural engineering, permitting jurisdiction, supply-chain conditions, and weather. We provide a written estimate after an on-site consultation, and a binding scope of work is established at contract signing.

Project Gallery and Reviews

Photos in our project gallery represent real Lifestyle Pool and Spa builds. Individual project results vary based on lot, scope, finishes, and homeowner preferences. Customer testimonials and Google reviews displayed on the Site reflect the experience of those specific clients and are not a guarantee of any particular outcome on your project.

Warranty

Our standard in-house warranty covers labor on completed installs. Equipment (pumps, heaters, valves, lights, automation) is covered by the original manufacturer’s warranty — owner’s manuals for every brand we install are linked from the Warranty page. Specific warranty terms, durations, exclusions, and claim procedures are defined in your signed construction contract. Intellectual Property

All content on the Site — including text, photographs, project descriptions, the “Lifestyle Pool and Spa” name and logo, graphics, layout, and design — is owned by Lifestyle Pool and Spa, LLC or its licensors and is protected by United States copyright and trademark law. You may not reproduce, redistribute, or use any of this content for commercial purposes without prior written permission. Limited personal, non-commercial viewing is permitted.

Third-Party Content and Links

The Site embeds and links to third-party services — including BuilderTrend (consultation form and client portal), Google Maps, Google Analytics, and third-party manufacturer owner’s manuals (PDF). We are not responsible for the content, accuracy, availability, or privacy practices of those third parties. Use of those services is governed by the relevant third-party terms of service.

Disclaimer of Warranties for the Site

The Site is provided “as is” and “as available.” To the fullest extent permitted by Florida law, Lifestyle Pool and Spa disclaims all warranties, express or implied, regarding the Site, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

This disclaimer applies only to the Site itself. It does not limit, replace, or modify the warranties expressly provided in your signed pool-construction or remodeling contract with Lifestyle Pool and Spa.

Limitation of Liability

To the fullest extent permitted by Florida law, Lifestyle Pool and Spa and its officers, employees, sub-contractors, and trade partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Site — even if we have been advised of the possibility of such damages. This limitation does not apply to construction work performed under a signed contract, which is governed by that contract.

Indemnification

You agree to indemnify and hold harmless Lifestyle Pool and Spa, LLC and its affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Site.

Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the personal jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time as our business, the Site, and applicable laws evolve. The “Last updated” date at the top reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
